Terms of Service

"Company," "we," "our," or "us" in these Terms refers to Ochtagon.

"Services" refers to our website at ochtagon.com and any product created and maintained by Ochtagon — including the web platform, any mobile application, and all associated features such as predictions, leagues, leaderboards, and analytics tools — whether delivered within a web browser, mobile application, or another format.

"You" or "your" refers to the person or organization that owns an account with Ochtagon.

Ochtagon is a sports prediction platform for MMA and UFC events. It is designed for entertainment purposes only. We do not facilitate real-money gambling or wagering of any kind. No cash prizes are awarded based on prediction performance unless explicitly stated in a separate, time-limited promotional event with its own official rules.

• You must be at least 18 years old to create an account and use our Services.
• You are responsible for maintaining the security of your account and password. Ochtagon cannot and will not be liable for any loss or damage resulting from your failure to keep your account secure. We recommend enabling two-factor authentication where available.
• You are responsible for all content posted and all activity that occurs under your account.
• Each person may maintain only one active account. Creating multiple accounts to gain a competitive advantage, manipulate leaderboards, or circumvent suspensions is not allowed and may result in all associated accounts being permanently banned.
• You must provide accurate, complete, and current information when registering. If we discover that information is false or misleading, we reserve the right to suspend or terminate your account.
• You may register using an email address and password, or through a supported third-party provider such as Google or Discord. You are responsible for any activity that occurs through those linked accounts.

• If you are using a free version of Ochtagon, it is genuinely free — we do not ask you for a credit card or sell your data to support it.
• For paid features that offer a free trial, we will explain the trial length when you sign up. After the trial ends, you need to pay in advance to keep using those features. If you do not pay, access to paid features will be paused until payment is made.
• If you upgrade from a free plan to a paid plan, we will charge your card immediately and your billing cycle starts on the day of upgrade.
• All fees are exclusive of applicable taxes. Where required by law, we will collect taxes on behalf of the relevant authority. You are responsible for any taxes not collected by us.
• Payments are processed securely through Stripe and PayPal. By providing payment information, you authorize us to charge applicable fees to your payment method.
• All purchases are generally non-refundable except where required by applicable law or as stated at the time of purchase. If you believe you were charged in error, contact us at Ochtagon@gmail.com within 14 days of the charge.

• You are solely responsible for properly canceling your account. You can cancel at any time through your account settings or by contacting us at Ochtagon@gmail.com. An email request to cancel is not automatically considered a cancellation until confirmed.
• If you cancel before the end of your current paid billing period, your cancellation will take effect at the end of that period and you will not be charged again. We do not automatically prorate unused time.
• If you cancel a subscription, you will retain access to paid features through the end of your current billing period.
• We reserve the right to suspend or terminate your account and refuse any current or future use of our Services for any reason at any time. Reasons may include, but are not limited to: violation of these Terms, abusive behavior, multi-accounting, fraudulent activity, or actions that harm the platform or other users.
• Verbal, written, or other abuse — including threats — directed at any Ochtagon team member will result in immediate account termination.
• Upon termination, your right to use the Services ceases immediately. Account data may be deleted in accordance with our Privacy Policy.

• Registered users may submit predictions ("picks") for upcoming MMA events. Picks must be submitted before the lock time for each event. Picks submitted after the lock will not be accepted — no exceptions.
• Ochtagon uses the MAX-DOP scoring system to evaluate predictions. Scoring is calculated automatically based on official fight results after each event.
• We reserve the right to adjust or correct scoring if official results change — for example, following an overturned decision, a no-contest ruling, or a fighter disqualification. Our scoring decisions in these situations are final.
• If a fight is cancelled or postponed after picks are locked, we will handle scoring fairly, which may include voiding picks for that bout. We'll make reasonable efforts to communicate any changes.
• Attempting to manipulate scores, picks, or leaderboard standings through any fraudulent means — including collusion with other users — is strictly prohibited and will result in disqualification and account termination.

• Users may create or join public and private leagues. If you create a league, you are acting as the commissioner and are responsible for managing your league settings fairly and communicating rules clearly to participants.
• Ochtagon is not responsible for disputes between league members. We encourage commissioners and participants to resolve conflicts directly.
• Commissioners may not use their administrative privileges to unfairly manipulate standings, remove participants for discriminatory reasons, or otherwise abuse the league system.
• Any attempt to rig league outcomes through multi-accounting, collusion, or other means will result in disqualification from the league and may result in permanent account suspension.

We intend to keep Ochtagon running and improving for as long as it is possible and reasonable to do so. That means we will continue to maintain security, privacy, and support even for older parts of the platform. That said:

• We reserve the right to modify, add, or remove features at any time. Sometimes we redesign something because we think it can be better; sometimes a feature becomes technically unworkable. We'll do our best to communicate meaningful changes in advance.
• We may change the pricing structure for paid features. If we change pricing for existing subscribers, we will give at least 30 days' advance notice via the email address on your account before the change takes effect.

Your use of the Services is at your own risk. We provide them on an "as is" and "as available" basis. While we take uptime seriously, we do not offer formal service-level agreements.

• We take meaningful steps to protect your data through backups, redundancies, and encryption. We enforce encryption for data transmitted over the public internet.
• We use PostHog to collect anonymized usage analytics that help us understand how people use Ochtagon and improve the product. PostHog does not receive your personal information for advertising purposes. See our Privacy Policy for full details.
• On rare occasions, our team may access your account to help with a support request (with your express consent), to diagnose an error in an automated process, or to safeguard the platform. We will never access your account for commercial purposes beyond what is necessary to operate the Services.
• We use third-party vendors and partners to run Ochtagon, including hosting providers, payment processors (Stripe, PayPal), authentication providers (Google, Discord), and MMA data sources. Your use of the Services is also subject to those providers' relevant terms.
• You agree that Ochtagon may process your data as described in our Privacy Policy and for no other purpose.

• All content you post on Ochtagon must comply with applicable copyright law. You are responsible for ensuring you have the rights to anything you share on the platform.
• By posting content — such as profile information, comments, or picks — you give us a limited license to use that content to operate and improve the Services. We claim no ownership rights over your content. All materials you submit remain yours.
• We do not pre-screen content, but we reserve the right to remove any content we determine — in our sole discretion — to be in violation of these Terms or otherwise objectionable.
• Ochtagon and its licensors own all right, title, and interest in the platform itself — including all software, design, and intellectual property. You may not duplicate, copy, or reuse any portion of the platform's HTML, CSS, JavaScript, or visual design elements without our express written permission.
• Fighter names, images, event names, and related marks are the property of their respective owners. UFC® and Ultimate Fighting Championship® are registered trademarks of Zuffa LLC. Their use on this platform is for informational and entertainment purposes only and does not imply any affiliation or endorsement.
• You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Services without our express written permission.

You agree that Ochtagon is not liable to you or any third party for damages of any kind that result from:

• Your use of — or inability to use — the Services
• Errors or inaccuracies in fight data, scoring, or leaderboard results
• Unauthorized access to or alteration of your data or account
• Actions of any third party that uses the Services
• Any other consequences related to these Terms or the Services

To the maximum extent permitted by applicable law, Ochtagon's total liability to you for any claim arising from these Terms shall not exceed the greater of (a) $100 USD or (b) the total amount you paid to Ochtagon in the 12 months preceding the claim.
